Op-Ed: Was a 'No' Vote Big Government Intrusion?
Lehigh County Commissioner Brad Osborne chastises a “bloc” of fellow commissioners who he says allowed their personal agenda to overshadow their duty in a vote on the Lehigh County Authority.

Five hundred years ago, Niccolo Machiavelli wrote a book titled The Prince. One phrase from that text that remains a paradox today is “the end justifies the means.” In other words, an action can be justified by the intended outcome rather than the action itself. On Wednesday, March 13, five members of the Lehigh County Board of Commissioners exercised the political equivalent of this maxim. In doing so, they not only diminished the integrity of our office, but also increased the uncertainty of the future cost of water and wastewater treatment in Lehigh County. How is that?
The Board voted, by the slimmest of margins, 5-4, to deny the extension of the Lehigh County Authority (LCA) charter, in order that they not meet the bid requirements for the pending Allentown water and wastewater system lease. These commissioners, known as “the bloc” for their record of voting together, brushed aside the very facts they professed to need, to decide in favor of the result they wanted. Deny the extension LCA needed to bid on the lease, and maybe we can scuttle Allentown’s plan of financing their pension debt by eliminating the most viable, publicly accountable bidder. Was this decision based on good government principles or a need to feel powerful?
Our responsibility as Lehigh County Commissioners was to evaluate the performance of LCA since the last charter extension in 1999 and determine if they were worthy of another 14-year extension. The board proceeded to detail the necessary elements of the charter review. It was a good, comprehensive framework from which to work. It included financial metrics, environmental records and customer satisfaction measurements. In short, everything you’d need to know to make an informed decision as a commissioner. We studied this matter for seven weeks, which included a public forum moderated by the League of Women Voters, a 4-hour public hearing conducted by a commissioner subcommittee, and unfettered access to any information we wanted. We were approached by communities ranging in size from Lower Macungie to Upper Milford, organizations as diverse as the East Penn Chamber of Commerce, Renew Lehigh Valley, Lehigh Valley Partnership and Wildlands Conservancy, respected businesses such as Samuel Adams Brewery and Ocean Spray, and professionals in the field to listen to their positive experiences, and consider their informed and reasoned recommendations. The board had no unanswered questions, no outstanding concerns about LCA’s performance, and understood the weighted opinion of the public. We were ready to make a decision.
What was our response to all this information, study and analysis? Denial of the request by a five to four vote. How did that happen? Concern was shifted from the tangible and measurable performance of LCA, to the intangible and immeasurable argument of how bad an idea the lease of the water system is. That should not have been the basis of our decision; that was outside our scope and jurisdiction. The “bloc” allowed their personal bias and agenda to overshadow their duty, and used words such as “toxic”, “house of cards”, “bad deal” and “city politicians” to justify their denial. In other words, they employed Machiavellian tactics to force an outcome they want to see down the road.
This could turn out to be a costly mistake that will raise water rates on families and businesses for years to come. Their actions may prevent an established, non-profit, regional organization with local government oversight from bidding. It was a shortsighted decision based on personal politics. Simply put, it is bad public policy.
To make matters even worse, a member of the bloc proposed using our board and county resources to investigate and pursue every legal means possible to stop the city transaction from taking place. These self-proclaimed believers in limited government are now apparently ready to expand the role of County government to attack those municipalities they disagree with. Isn’t the contradiction evident?

@ for real - I agree with all but one thing you just said. Putting labels on candidates like Republican, Democrat, Tea Party, or whatever, often obfuscates the true motives of those candidates. I'm not familiar with Nate Brown yet, but Percy Dougherty represents everyone who values common sense and fairness, regardless of their party affiliation. I happen to be a Democrat, but I will say without reservation that Percy gets my vote because he is a true pubic servant. The residents of Lower Macungie got screwed out of fair representation 4 years ago, because too many of them cast the straight-party ballot and elected 3 realtors to our board of commissioners. You've seen the results - a sweetheart deal for Jaindl to rezone 700 acres of preserved farmland for warehouses and strip malls. If voters would have looked at the agendas of Schware, Aquilla and Ott instead of just looking at their party affiliation, this debacle with LCA might have been avoided. Save the partisan politics for the national stage. On the local level we all have to take the time to figure out which candidate will do a better job of protecting our backyards, and in this case, our drinking water, regardless of party.

Fair enough Scott. I vote mostly Republican but never tea party. I'm not overly familiar with the farmland stuff you are talking about. I do think Lower Mac. is getting over developed especially with residential. We need industry to balance this out. Some of these extremists are now lining up to oppose the Hamilton Crossings development because of the TIF. Again ideology first what is best for the taxpayer last.

I am not surprised to read Brad Osborne quoting Machiavelli, since he lives by Machiavellian principals. As Commissioner, our responsibility is to the all the residents of Lehigh County. If the LCA paid $200 million for a 50 year lease of the Allentown system (which is the amount the city is seeking) the rate payers of the county would be saddled with over $400 million in additional debt service, without a single ounce of improvement in the system. My fear was that the LCA wanted to take control of the system at any cost. They proved me correct by changing their position, which was that they would not bid without the charter extension. They are now planning to bid anyway. If the LCA takes responsibility for the system and finds themselves in a position where they can not make these payment, Lehigh County would be forced to make the payments, since we would not permit the system to fail. Mr. Osborne voted against the $5 million tax and spending reductions proposed by the 5 conservative Republican members of the County Commission. Then he worked with Democrats on the commission to develop an alternative plan. he never once informed the Republican majority of his efforts. He never even told us that he was participating in a news conference to announce the alternate plan. Due to his lack of leadership, and since he could not be trusted, the Republican majority failed to reappoint him Chairman of the Board. The right choice. Vic Mazziotti Lehigh County Commissioner

Vic, You came to the table open to the LCA lease extension, until you saw how it was a backdoor way to screw Lehigh County. Most residents don't want to pay for Allentown union pensions, and the extension was the key to the sham transaction that would have been illegal on its own. Thanks for proper analyzation of the issue. I was also very impressed with Mike Shware and the arguments he jointly raised.

Vic supported 5 million in spending reductions and 5% tax decrease. That plan fixes absolutely nothing and DOUBLES the structural deficit. He helped run Northampton County into the ground and is now doing the same to Lehigh. Remember, Vic ran for elected office as a member of the Patriot party. He is certifiable.

To Mr Landi. It should be in your best intrest as a borough resident to have LCA to Bid for the lease of Allentown's water system. We as a borough have our water treated by the city's treatment plant. If a private entity is awarded the bid, our rates will increase drastically. LCA (a non-profit orginization) has provided water and sewer services to Lehigh County residents for some years now. They know their customers. I agree that we as Emmaus Residents should not bail out Allentown's financial woes. But this is the best option for the county. "The Bloc" said they want more oversight of LCA's operations at their last county meeting. To me that shows the intent to expand county covernment into LCA and if they do not get their way they will mount a legal attack against LCA and the city with tax payer dollars. I thought this is what they are against big government and wasting tax payer dollars. I believe LCA has the right to the bid process just as any other entity.

Mr. Brown - have you seen financial statements from the LCA showing that they would be able to take on $250 million in new debt and not raise the rates? If the LCA takes over Allentown's water system how are they going to pay down that debt and also pay the wages and benefits for all the employees they will have to hire without raising rates? If the current rates could pay for all of that Allentown wouldn't have to sell their system.

It appears that either the Allentown sewer workers union or the LCA union have hacked Wayne Woodman's and my Patch account. They are the only ones with the motivation and nastiness that only a government union worker has. Could Pawloski or Arndt put a muzzle on their henchmen, probably not as they are in cahoots. Nah, they know who they represent, and it ain't the ordinary citizen.

The "Our way or the highway" sector of the Republican party must come to an end in Lehigh County. Their tactics, figure headed by chairman Wayne Woodman are that of bullying and mean spirited vindictive tactics. I have been affected by this first hand, and have seen Scott Ott, Wayne Woodman's, and the Bloc of the commissioners treat others that they may not agree with 100 percent. These people have an agenda, and their agenda is not serving the constituents with proper decorum and diplomatic behavior. I can assure you, that their ways have now caught up to them, in the May primary, the people of Lehigh County will make their voices heard, loud and clear. The people want sensible, hardworking, and bipartisan legislatures. Not that of what we have seen by the Bloc voting tactics.

In the end we all have a burden to help Allentown out with their pension coasts, either through the LCA or other out of srea corporation. Either entity will raise fees which effect the region as Allentown supplies water to EVERYONE, this vote was short sighted and ill conceived by a bunch of idiots who are politicians with no prior experience running government...Am I right Ott and Scheller? When big our govt sewer authority is given millions of dollars to fix a a broken sewer system but fail miserably by putting band aids on the system and permitting sewage overflows into the Little Lehigh Creek, something is wrong with this picture. I do not trust any of the bidders and the city of Allentown in correcting this problem. LCA, Allentown and the townships are under an Admin order from EPA yet I hear no one mentioning how they will correct the sewage overflow permanently. Who speaks for the Little Lehigh Creek when sewage is dumped into the creek where our children fish and drink our water? You guys better stop arguing about the political nature of this sale or we will not have any water to drink and concentrate how LCA and Allentown are going to resolve the sewage overflows permanently. If you really care about the sewage and water, you must demand that PADEP and EPA issue a ban for new hookups. The bidding process will end right there
